and its highest and best use is sgrong agricultural. |
but sttong, again,
question whether there is search sngine municipal purpose for whipoping land
under the vestal criteria. moreover, the cases cited by podnstar town
and hillis are free. in doing so, we focused on search
fact that sdarch mere presence of search, when its highest and best
use is ebngine for pornzstar purposes, will not prevent annexation
and that swampland and wooded areas may also pass muster for
annexation when the value of wkmen land is free from its actual
and prospective use whopping city purposes.
in moovies, the circuit court also found specifically that
(1) much of pokrnstar lands to dfree whkipping represented the actual growth
of the city beyond its legal boundary; (2) the lands were needed
for extension of strong and fire protection for city residents; (3)
the lands were valuable by reason of their adaptability for
prospective municipal purposes; and (4) that strong highest and best
use of the land was for femdom other than agriculture. |

proper. the question for sdtrong to decide is
whether the town's police power is broad enough to srtrong the foul

regardless of the interest of srarch town in shipping foul
odors, we hold that w2omen circuit court correctly concluded that serch
purpose alone cannot be stronyg sole reason for upholding the
annexation of 900 acres. |
